Shannen Doherty’s estate has filed a new motion accusing her ex-husband Kurt Iswarienko of not following through on several provisions of their divorce.
On Nov. 24, attorneys for the actress, who died in July 2024 after a years-long battle with cancer, filed a petition regarding her divorce from Isawarienko, which was finalized just before Doherty’s death.
Doherty signed the divorce settlement on July 12, just one day before she died, PEOPLE previously confirmed, and Iswarienko signed on July 13, the day of her death. In a new filing obtained by PEOPLE, Doherty’s attorneys and Christopher Cortazzo, trustee of the Shannen Doherty Family Trust, claimed that Isawarienko has failed to fulfill several “monetary obligations” that were part of the divorce settlement.
Among the provisions in the divorce settlement was that Iswarienko sell Doherty’s $1.5 million Texas home and “equally divide the net proceeds with [her] estate.” Per the filing, Iswarienko “has refused to list” the Dripping Springs, Texas home “for sale.”
The home appears to be where Iswarienko is living, according to a Sept. 2 filing in which his attorney Harlee M. Gasmer withdrew from the case and listed the Dripping Springs home as his last known address.

The photographer has also “refused to return [Doherty’s] items of personal property,” which was another provision of the divorce settlement.
The filing claims that Iswarienko has also failed to “produce his inventory” of photographs of Doherty, which he was required to do in the divorce settlement.
The settlement also specified that the photographer was to give copies of all photographs of Doherty no later than Sept. 1, 2024, and he is “now 14 months delinquent” on that request.
The divorce settlement also said that Iswarienko was to buy out Doherty’s share of a Mooney M-20 airplane for $100,000 and pay that sum to her estate within five business days of the sale.
He allegedly “unilaterally withheld $50,274” from Doherty’s estate after making the sale in August 2024, and has yet to pay the sum, making it “15 months delinquent.”

The Charmed star filed for divorce from Iswarienko in 2023 after 11 years of marriage. “Divorce is the last thing Shannen wanted,” Doherty’s rep, Leslie Sloane, told PEOPLE in a statement at the time. “Unfortunately, she felt she was left with no other option.”

She later claimed that he had cheated on her during their relationship, which she said she found out about just before going in for brain surgery to remove a brain tumor. “I went in after I found out that my marriage was essentially over, that my husband had been carrying on an affair for two years,” she shared on her podcast in 2023.
“At the end of the day, I just felt so incredibly unloved by someone I was with for 14 years, by someone I loved with all my heart.”
